Right of access to data: You have the right to request information from us about which of your personal data we store at any time.

Right to data portability: When Happy Pumpkin processes your personal data in an automated manner, based on your consent or a concluded contract, you have the right to receive a copy of your data in a structured, commonly used and readable format. This copy may be sent to you or to another entity. This only applies to personal data that has been provided to us.

Right to correct data: You have the right to request that your personal data be corrected if they are incorrect, as well as to complete incomplete data. If you have an account with Happy Pumpkin, you can edit your personal details on your account page.

Right to delete data: You have the right to delete any data processed by Happy Pumpkin at any time.

Right to object to direct marketing: You have the right to object to receiving direct marketing materials, including the analysis of your profile that is being prepared to prepare such materials.

Right to lodge a complaint with a supervisory authority: If you believe that Happy Pumpkin is processing your personal data incorrectly, you can contact us. You also have the right to lodge a complaint with the supervisory authority.

3. Data retention period


Online Shopping: We will keep your details for as long as you are an active customer.

Direct marketing: We will retain your data for direct marketing purposes until you withdraw your consent.

Happy Pumpkin Account: We will keep your data for as long as your Happy Pumpkin account is active.

Customer service: In the case of complaints reported in the store, the data will be stored for 2 years.

Compliance with legal obligations: We will retain your data for as long as required by accounting rules in your country.


4. For what purpose do we collect, save and process user data?

4.1. Happy Pumpkin account


For each customer who registers on our website using the "Create an account" function, we create a customer account, i.e. password-protected direct access to the user's master data stored with us. Here, the user can, among other things, see his completed, pending and recently shipped orders or manage his personal data and newsletter.

When registering a customer account, the following data must be provided (required information): e-mail address, password, name, surname, consent to the provisions on the protection of personal data.

We will use your personal information to set up and maintain your account and to provide you with personalized services on the Happy Pumpkin website.

4.2 Online Shopping


We use your personal information to manage your online purchases from Happy Pumpkin, to process your orders and returns, and to send you notifications about delivery status or if there are any issues with the delivery of the products. We will use your personal information to manage your payments. We will also use your data to process product complaints and warranty claims. With your personal information, we can identify you and check whether your age qualifies you for online shopping, as well as confirm your address with third parties.

We will process the following personal data:

- contact details such as name, address, e-mail address and telephone number
- payment information and payment history
- information about orders

If you have a Happy Pumpkin account, we will also process your personal data provided in connection with this account, including:

- account ID
- purchase history


4.3. Use of data for marketing purposes


We will use your personal data to send you marketing offers, surveys and invitations - by e-mail or SMS, and to recommend products that may be of interest to you.

For this purpose, we use the information obtained, e.g. about the end device owned by the user, Internet connection, operating system and platform, date and time of visiting the website or viewed products, as well as information that we obtain from the user (including information provided automatically or generated ). In addition, we also use your order history.

You can object to the use of your personal data for advertising purposes at any time, in whole or in relation to individual activities. For this purpose, a notification in text form to the contact details listed in point 1 (e.g. e-mail, letter) is sufficient.


4.3.1 Newsletter

Customers have the option of subscribing to our newsletter by providing an e-mail address and consenting to the processing of personal data for marketing purposes and sending commercial information. Through the newsletter we inform you about our latest offers. You can unsubscribe from the newsletter at any time by clicking the link contained in the received newsletter, by sending an e-mail to: sklep@happypumpkin.pl or in the My Account section. There is an unsubscribe link in every email.

4.3.2 Emails with recommended products


If you have purchased from Happy Pumpkin, we may send you emails with product recommendations. These messages are sent regardless of whether the user has subscribed to the newsletter or not. In this way, we want to provide you with information about products from our offer that could be of interest to you based on your recent purchases.

If you wish to opt out of receiving product recommendations or advertising communications from us in general, you may withdraw your consent at any time. For this purpose, a notification in text form to the contact details listed in point 1 (e.g. e-mail, letter) is sufficient. There is an unsubscribe link in every email.


4.3.3 Banner Advertising


We also use the data collected during the user's visit to display the so-called banner ad. These are advertisements that redirect to third-party websites. This ad mostly uses cookies or pixels. Our goal is to develop an advertising offer that will be attractive and useful to the user, therefore, as part of banner advertising, the user may see primarily products that he has already viewed on our website or products similar to those viewed by him before (so-called retargeting).

5. Cookies (cookies)


A cookie is a small text file that is saved on your computer or mobile device and then downloaded from it during subsequent visits. Access to the information contained therein is used for statistical purposes, for marketing purposes (remarketing) and to ensure proper operation of the website.

What data is saved in cookies?


Only pseudonymised data is stored in the cookies used by Happy Pumpkin. When activating a cookie, an identification number is assigned to it without assigning the user's personal data to this identification number. The name, IP address or similar user data that allows the cookie to be assigned directly to the user are not stored in the cookie. Based on cookie technology, we only obtain pseudonymized information, for example about which pages of our store the user has visited, which products he has viewed, etc.

How can you not agree to the installation of cookies using the browser settings?

A user who does not want cookies to be installed on his telecommunications end device may refuse to consent to the installation of cookies in the following way:

1. In the Internet Explorer browser: select "Tools/Internet Options" from the main menu, then in the "Privacy" section select "Advanced" and disable cookies.
2. In the Mozilla Firefox browser: select the "Tools" item from the menu and then the "Options" item and specify the level of privacy in the "Privacy" section.
3. In the Opera browser: select the "Tools" item from the menu, then select "Advanced" and then "Cookies" from the "Preferences" item.
4. In the Google Chrome browser: from the menu on the right, select "Options" and then "For advanced" and "Cookie settings".

The above types of browsers have been indicated as examples. Due to the large variety of browsers used by Users, there may be some differences in the way they are set, which would prevent the installation of cookies. 6. Log files


Your use of the Happy Pumpkin website involves sending inquiries to our server. These include data including IP address, as well as information about the web browser and operating system. This data is not associated with specific people using Happy Pumpkin. They only serve to administer the website more effectively. These log file data records are analyzed by us in order to optimize the offer and to make the Happy Pumpkin shop as user-friendly as possible, as well as to detect and rectify errors faster and to manage server performance.


7. Web analysis, remarketing


In order to continuously optimize and improve our offer, we use so-called tracking technologies. The store uses technologies that track user activities: Google Analytics statistics, plugins from social networking sites: Facebook, Instagram and Twitter, as well as communication and marketing tools such as Tidio, Mailchimp. 8. Who can we transfer your data to?
The data may be transferred to entities processing personal data on behalf of Happy Pumpkin P.U. Pawel Bozyk, among others IT service providers, marketing agencies, research companies, business partners, transport companies - where such entities process data on the basis of an agreement with the administrator and only in accordance with the instructions given.
9. Where do we store data?
In accordance with the GDPR, we have signed a new Personal Data Entrustment and Processing Agreement with our hosting provider. All data collected by our store is stored on the servers of cyber_Folks S.A. with its registered office in Poznań, Franklina Roosevelta 22, 60-829 Poznań, entered into the National Court Register by the District Court in Poznań - Nowe Miasto and wilda in Poznań, 8th Commercial Division of the National Court Register, under the number KRS 0000612359, REGON 364261632, NIP 7822622168.
